Terms of Service

The rules for using iMingle. We've tried to keep them short and in plain language.

1. Agreement to these Terms

These Terms of Service (the Terms) are a legal agreement between you and iMingle (we, us, or iMingle) covering your use of the website at imingle.fun and the chat services available there (together, the Service).

By opening a chat, creating an account, or otherwise using the Service, you agree to these Terms, our Privacy Policy, and our Community Guidelines. If you do not agree, please do not use the Service.

2. Eligibility

You must be at least 18 years old to use iMingle. The Service connects you with strangers and is not designed for, or directed at, minors.

You also confirm that:

  • you are legally able to enter into a binding contract where you live;
  • you have not previously been banned from the Service; and
  • your use of the Service is not prohibited by any law that applies to you.

3. The Service

iMingle randomly pairs you with another person for a one-to-one text chat or video chat. The core Service is free and does not require an account. Either participant can end a chat at any time.

Text messages are relayed between participants in real time through our servers and are not stored. Video and audio are transmitted through Agora, a third-party real-time communications provider, and are not recorded by us. See our Privacy Policy for details.

We may change, suspend, or discontinue any part of the Service at any time, including features available in free or paid tiers.

4. Accounts

An account is only required for Premium. To create one we ask for an email address, a display name, and a password. You agree to:

  • provide an email address that belongs to you and keep it up to date;
  • choose a display name that does not impersonate anyone or break our Community Guidelines;
  • keep your password confidential and not share your account; and
  • tell us promptly at [email protected] if you believe your account has been compromised.

You are responsible for everything that happens under your account. You can delete your account at any time from your account settings or by emailing us.

5. Premium subscriptions and billing

Premium is an optional paid subscription that adds features such as country and interest filters, priority matching, and appearance customization. The features included in Premium may change over time.

  • Price. Premium currently costs $4.99 per week, plus any applicable taxes. The price shown at checkout is the price you pay.
  • Payments. Payments are processed by Stripe. We never see or store your full card details. By subscribing you also agree to Stripe's terms.
  • Automatic renewal. Your subscription renews automatically each week until you cancel. We will charge the payment method on file at the start of each billing period.
  • Cancellation. You can cancel at any time from your account settings. Cancellation takes effect at the end of the current billing period, and you keep Premium until then.
  • Refunds. Except where required by law, payments are non-refundable and we do not provide refunds or credits for partial weeks. If you believe you were charged in error, contact us and we will look into it.
  • Price changes. We may change the Premium price. We will give you at least 30 days' notice by email before a change takes effect, and you may cancel before then.
  • Bans. If your account is terminated for violating these Terms or the Community Guidelines, you are not entitled to a refund.

6. Acceptable use

Our Community Guidelines are part of these Terms. In short, while using the Service you must not:

  • be under 18, or engage with anyone you believe to be under 18;
  • share, request, or display nudity or sexual content, or solicit sexual activity;
  • harass, threaten, bully, or abuse anyone, or promote hatred against any group;
  • record, screenshot, or otherwise capture another person's chat, image, or voice without their clear consent, or share such material;
  • post or share personal information about others (doxxing);
  • use the Service for anything illegal, including fraud, scams, or the sale of illegal goods;
  • send spam, advertising, or links to other services, or use bots or automation;
  • impersonate any person or organization;
  • attempt to access other users' data, interfere with the Service, or bypass bans, rate limits, or security measures; or
  • reverse engineer, scrape, or build a competing service using our systems.

7. Your content, and what we do and don't keep

You own whatever you say or show during a chat. Because we do not store messages or record video, we generally do not hold copies of your chat content. To operate the Service we need a limited right to transmit your content between you and the person you are matched with, and you grant us that right.

When you submit a report, we may temporarily retain the information you include in it (for example, a description of what happened) so we can review it.

You are solely responsible for what you say and show. We do not endorse and are not responsible for the content or conduct of other users.

8. Reporting, moderation, and enforcement

You can report another user from within any chat. We review reports and may, at our discretion and without notice:

  • warn a user;
  • temporarily or permanently block a user, device, or network from the Service;
  • remove Premium access without refund; and
  • preserve and share information with law enforcement where we believe it is required by law or necessary to prevent serious harm.

To enforce bans we may keep limited technical identifiers (such as an IP address or a hashed device identifier) for as long as necessary. Attempting to evade a ban is itself a violation of these Terms.

9. Third-party services

The Service relies on third-party providers, including:

These providers have their own terms and privacy policies. We are not responsible for their services, and outages or changes on their side may affect the Service.

10. Intellectual property

The Service, including its name, logo, design, and software, belongs to us or our licensors and is protected by intellectual property laws. We grant you a limited, personal, non-transferable, revocable license to use the Service in accordance with these Terms. You may not copy, modify, distribute, or create derivative works from any part of the Service without our written permission.

11. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not verify the identity, age, or intentions of users. You interact with other people at your own risk. Use common sense: do not share personal details, do not send money to strangers, and end any chat that makes you uncomfortable.

We do not guarantee that the Service will be uninterrupted, secure, or error-free, or that any particular feature will remain available.

12. Limitation of liability

To the fullest extent permitted by law, iMingle and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, goodwill, or profits, arising out of or related to your use of the Service or your interactions with other users.

Our total liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid us in the 12 months before the claim arose, or (b) 50 US dollars.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.

13. Indemnification

You agree to defend, indemnify, and hold harmless iMingle from any claims, damages, and expenses (including reasonable legal fees) arising from your use of the Service, your content, or your violation of these Terms or of any law or third-party right.

14. Termination

You may stop using the Service at any time and may delete your account from your settings. We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms or if we need to protect the Service or other users.

Sections that by their nature should survive termination (including Disclaimers, Limitation of liability, Indemnification, and Governing law) will survive.

15. Changes to the Service or these Terms

We may update these Terms from time to time. If we make material changes, we will post the updated Terms here with a new "last updated" date and, where you have an account, notify you by email. Continuing to use the Service after the changes take effect means you accept the updated Terms.

16. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules. Any dispute arising from these Terms or the Service will be brought in the courts located there, and you consent to their jurisdiction, unless the consumer protection laws where you live give you the right to bring a claim elsewhere.
